Effective August 29, 2025, the de minimis exemption for low-value shipments (under $800 USD) to the U.S. has been suspended meaning all U.S. imports, regardless of value, origin, or entry mode, will be subject to applicable U.S. duties and taxes that may be charged to the receiver of the goods if the shipper did not prepay these fees in advance.
This change has resulted in a substantial rise of formal customs clearances, which has led to increased processing times and delays particularly for shipments that require other government agencies like FDA eligible shipments.
Actions to Take:
- Provide UPS with a document or CUSMA certification for your goods.
- Submit the certification with your commercial invoice for CUSMA exports to the U.S.
- Ensure complete and accurate commercial invoice information, including product details, country-of-origin, HTSUS code, quantity, and value.
- It is now mandatory for all shipments to the U.S. to include information pertaining to the country-of-origin for each commodity on your commercial invoices when creating your shipment.
- For shipments requiring formal entries, provide an Importer Tax ID with EIN or SSN.
- Include the recipient’s email and contact information for duty and tax collection.
